These Terms and Conditions govern your use of this website and your engagement of the services offered by Vitalis Health. By using this website, by submitting information through our online health assessment tools, or by booking or paying for any service, you confirm that you have read, understood and accepted these terms. If you do not accept them, please do not use the website or our services.
Vitalis Health, Lifestyle Disease and Longevity Clinic, is a sole proprietorship concern of Dr. Jisha V, with its place of business at Door No. 64, 2699-B1, Dr George Road, Kathrikadavu, Kaloor, Ernakulam, Kerala 682017. In these terms, “we”, “us” and “our” refer to Vitalis Health, and “you” refers to the person using the website or availing the services.
We provide preventive health assessment, lifestyle disease management, medically supervised weight management, diabetes care and related consultative services. Services may be delivered in person at the clinic or remotely by video consultation, as appropriate to your clinical requirement.
Our service is consultative and advisory in nature. It is designed for the assessment and the long term management of lifestyle related conditions and risk factors.
This is not an emergency medical service. We do not provide emergency, urgent or acute care, and we do not offer round the clock medical cover.
If you are experiencing chest pain, breathlessness, sudden weakness or numbness, difficulty in speaking, loss of consciousness, severe bleeding, a severe allergic reaction, thoughts of harming yourself, or any other condition that may be an emergency, do not use this website and do not wait for a scheduled appointment. Contact emergency services immediately or proceed to the nearest hospital with emergency facilities.
The articles, guides, calculators, screening tools and other content on this website are provided for general information and health awareness only. They do not constitute medical advice, diagnosis or treatment, and they are not a substitute for consultation with a qualified physician.
Using this website, reading its content, or completing an online assessment does not by itself create a physician and patient relationship. That relationship is established only when you consult a physician of the practice and that physician accepts you for assessment or care.
Our online health assessment tools, including the Smart Health Screener, produce an indicative risk assessment based only on the answers you provide. The output is a guide to whether further evaluation is advisable. It is not a diagnosis, it does not rule out any condition, and it must not be relied upon in place of clinical examination and investigation.
The accuracy of any assessment depends entirely on the accuracy and completeness of the information you enter.
To book a service or make a payment on this website you must be at least eighteen years of age and legally competent to enter into a contract.
A person below the age of eighteen years may receive care only where the appointment is booked by, and the consultation is attended by, a parent or lawful guardian who consents to the assessment and treatment on the minor’s behalf.
You are responsible for providing complete, accurate and current information about your symptoms, medical history, existing diagnoses, current medication, allergies, previous investigations and lifestyle. Clinical advice is given on the basis of the information available to the physician.
Withholding relevant information, or providing information that is incorrect, may lead to advice that is inappropriate or unsafe for you. We accept no responsibility for any consequence arising from information that you have withheld, misstated or failed to update. You must inform us promptly of any material change in your health during the course of your care.
Diagnostic investigations are not performed by us. They are carried out by an independent third party laboratory.
Charges for diagnostic investigations are separate from, and additional to, any assessment or consultation fee. They are quoted to you itemised in advance and are billed by Vitalis Health.
Sample collection, testing methodology, turnaround time, quality control, reporting and the accuracy of results are the responsibility of the laboratory concerned.
A query about a diagnostic charge should be raised with us. A query about a result, or a request for a rerun, will be taken up by us with the laboratory. Once a sample has been collected or a test processed, the charge is not refundable, as it has been incurred with the laboratory on your behalf.
The fees applicable to each service are stated at the time of booking. Fees are payable in Indian Rupees and are inclusive of all applicable taxes. We reserve the right to revise our fees at any time, provided that a revision will not apply to a service already booked and paid for.
Where payment is made online, it is processed by a third party payment gateway. Completion of a payment does not by itself confirm an appointment. Your appointment is confirmed only when we issue a confirmation to you.
Appointment slots are allotted in advance and are held for you. You may reschedule an appointment by giving us at least twenty four hours notice before the scheduled time, subject to availability. Requests to reschedule may be made by telephone or by email to info@vitalishealth.in.
If you do not attend a scheduled appointment and have not informed us in advance, the appointment will be treated as a missed appointment. Cancellation, missed appointments and the circumstances in which a refund may be issued are governed by our Refund and Cancellation Policy, which forms part of these terms.
We may need to reschedule an appointment because of a clinical emergency, the unavailability of the physician, or a technical failure. Where this happens we will offer you the earliest available alternative slot or, at your option, a full refund in accordance with the Refund and Cancellation Policy.
Video consultations are provided in accordance with the telemedicine practice requirements applicable to registered medical practitioners in India. The following conditions apply.
Where a prescription is issued, it is issued by the treating physician on clinical grounds and is valid only for you. You are free to have a prescription filled at any pharmacy of your choice. Prescriptions must not be reused, shared or altered.
Our advice is intended to complement, and not to displace, care that you are receiving from another physician. Do not stop, start or alter the dose of any prescribed medication on the basis of website content. Any change to your existing treatment should be made only after discussion with the treating physician.
Where you enrol in a structured programme or a multi session package, the following applies.
You agree not to use the website in any manner that is unlawful, that infringes the rights of others, that attempts to gain unauthorised access to our systems or data, that introduces malicious code, that interferes with the normal operation of the website, or that involves automated extraction of content. You agree not to impersonate another person or to submit information on another person’s behalf without that person’s authority.
All content on this website, including text, graphics, logos, images, assessment tools, calculators, programme structures and design, is owned by us or licensed to us and is protected by applicable intellectual property law. You may view and print content for your own personal and non commercial use. You may not reproduce, republish, distribute, adapt or commercially exploit any part of it without our prior written permission.
This website may contain links to third party websites. Those websites are not under our control. We provide the links for convenience only and we do not endorse and are not responsible for their content, their accuracy or their privacy practices.
We provide our services with reasonable professional care and skill. Medicine is not, however, an exact science, and no outcome, result or improvement is or can be guaranteed. Individual response to any assessment, programme or advice varies.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special or consequential loss, for loss of income or profit, or for any loss arising from your failure to follow clinical advice, from information that you withheld or misstated, from delay or error on the part of a third party laboratory or service provider, from interruption of internet or telecommunication services, or from your reliance on general information published on this website.
To the maximum extent permitted by law, our aggregate liability in respect of any claim arising out of a service shall not exceed the amount actually paid by you to us for that service.
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by proven negligence.
You agree to indemnify us against any claim, loss or expense arising from your breach of these terms, from your misuse of the website, or from information that you have provided which is false or misleading.
Your personal data, including your health data, is handled in accordance with our Privacy Policy, which forms part of these terms.
We shall not be liable for any failure or delay in performing a service where that failure or delay arises from a cause beyond our reasonable control, including an act of God, natural disaster, epidemic, fire, civil disturbance, strike, failure of power or telecommunication services, or an order of a government or statutory authority.
We reserve the right to decline, suspend or discontinue a service where a patient behaves abusively towards our staff, where the therapeutic relationship has broken down, where a patient’s requirement falls outside our scope of practice, or where continuing would in our clinical judgement not be in the patient’s interest. Where we do so, any unutilised amount will be dealt with in accordance with our Refund and Cancellation Policy.
We may amend these terms from time to time. The amended terms will be posted on this page with a revised date and will apply to bookings made after that date. Please review this page periodically.
If any provision of these terms is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force.
These terms are governed by and shall be construed in accordance with the laws of India. Subject to any right you may have under consumer protection law, the courts at Ernakulam, Kerala shall have exclusive jurisdiction over any dispute arising out of or in connection with these terms or our services.
